In online videos and articles, Ben is often heard asking a question along the lines of, “Why do we need to legalize what Americans already have the absolute constitutionally-protected unalienable right to do, like paragliding, for example? I never voted to make it illegal to begin with!”
From my research, more and more people seem equally perplexed as to why our natural rights are eroding. Some deal with cognitive dissonance by acting as if everything is “just fine.” However, many more are flooding the offices of their so-called representatives with emails and phone calls and demanding answers. The English radical individualist philosopher Herbert Spencer distinguished between rights properly so-called, such as the rights to life, liberty and property, and political rights so-called, such as the right to vote. Nick Rockefeller told Russo years before 9/11 that Americans would see soldiers looking in caves for alleged terrorists and that there would be an “endless war…where there’s no real enemy and the whole thing is a giant hoax.” Russo revealed that Rockefeller was cynically laughing and joking as he made the astounding prediction. David Lane recently assisted the Fully Informed Jury Association (FIJA) and co-plaintiffs Eric Verlo and Janet Matzen of Occupy Denver in filing a motion for preliminary injunction to prevent harrassment by Denver cops after juror rights educators Mark Iannicelli and Eric Brandt were arrested and charged with seven felony counts each of jury tampering for sharing jury nullification information. Burning the Beekeeper: The Benjamin David Gilmore Story, which debuted in 2013 at the Lyric Cinema Cafe, casts doubt on Ben’s conviction, and compares it to Tim Masters’ wrongful conviction. After maintaining his innocence and losing two separate appeals in 1999 and 2002, Masters’ was granted hearings for a new trial in 2007.
“Tim Masters was a 15-year-old sophomore at Fort Collins High School when he spotted something that didn’t look real on his way to his bus stop. He walked up to within six feet of the woman’s body that lay on her back in a field about 100 feet from the 3800 block of South Landings Drive.
“Her bra, blouse and black coat had been pushed up above her breasts; her panties and bluejeans had been pulled down to her knees. It was also only 100 feet from the trailer where Masters lived with his father. To Masters, it looked more like a mannequin. It was very real though. In this case, new hearings uncovered that DNA found on the victim’s body did not match Masters’ DNA. The hearings also revealed there had been substantial evidence not turned over to Masters’ defense team during the previous trials. Masters conviction was overturned and prosecutors dropped the murder charge against him. The City of Fort Collins and Larimer County paid $10 million dollars to settle a federal civil rights lawsuit out of court with Tim Masters. Read more.
Did you know, the run-for-profit U.S. corporate government wants to track men and women’s DNA as if it were a license plate? Just as details are emerging about a controversial, nationwide vehicle-surveillance database…the federal government is planning an even more invasive spy program using “physiological signatures” to track down individuals. The goal of this research is to detect – as well as analyze and categorize – unique traits – like a telltale limp – the government can exploit to identify, locate and track specific individuals or groups of people. Stacy writes, “On Nov. 1, 2011, an undercover agent from the Bureau of Alcohol, Tobacco and Firearms attended the Fort Collins City Council Meeting… Special Agent Mark Feltz…went to the council meeting with people who had been attending Occupy Fort Collins protests. The group was at the City Council meeting to ask city officials for permission to continue its protest on the corner of College Avenue and Maple Street.”
Permission? Why are we, the bosses of our so-called “public servants,” asking permission to speak freely on our own public streets? That makes no sense to me at all!

“Two days after that council meeting, Benjamin David Gilmore was arrested for the crime of arson at Mason Street Flats and Penny Flats. The 2012 trial of Gilmore resulted in a hung jury. He was re-tried and convicted of arson in 2013, and then sentenced to eight years in prison.” Read more.
According to this article, published September 17, 2013, “Jurors were reportedly split 50-50 at the end of the first trial. The destroyed building was the under-construction Mason Street Flats apartment building. Next-door Penny Flats, where people were living, was severely damaged. The two buildings have been restored and completed at their locations along North Mason Street between Cherry and Maple streets.
“Gilmore’s previous defense attorney, Timothy O’Keefe, said after the first trial that jurors were torn on issues of burns to Ben Gilmore’s hands after the Oct. 25, 2011 fire, his Rolex watch that was found at the burn scene, and phone calls he’d made from jail. Prosecutors showed each of these as evidence of guilt, and the defense responded that Gilmore burned his hands spinning fire and had lost the watch.
According to Stacy, Gilmore filed his opening brief with the Colorado Court of Appeals. New evidence presented at the Community Information meeting, held Dec. 11, 2014, at Old Town Public Library, 201 Peterson St., reveals to the public previously unheard evidence as well as official court transcripts, ATF investigation reports and Fort Collins Police investigation reports.
1. Why did the district attorney keep critical evidence away from the jury?
2. Who has financial interests in Mason Street Flats and Penny Flats, and why does that matter to the taxpayers of Fort Collins and Larimer County?
3. How can a man be charged and convicted for the crime of arson when arson was not proven to be the cause of the fire?
4. What happened to the man identified as suspect No. 1, Gerardo Giovani “Clutter” Salazar? (Fort Collins Police Services, Case #11-16445, Supplemental Report #0031) Why did local detectives allow Salazar to leave town when they knew he had told people that he had started the fire? Why are detectives from an outside jurisdiction continuing to investigate Salazar’s death? (Detective David J. Silano, Lane County Sheriff’s Office, Eugene, Oregon, September, 2014) And, why was it reported at Mr. Gilmore’s trial that Salazar killed himself (Larimer County Eighth Judicial District, Official Court Transcript, Oct. 10, 2013, page 73), when suicide was not necessarily determined to be the cause of his death? “Nobody claimed to have seen Gilmore light the fire, and a cellphone video of a man leaving the scene in a hooded sweatshirt and dark clothing wasn’t clear enough for the person to be identified.”
Burning the Beekeeper: The Benjamin David Gilmore Story, reveals evidence, from two separate trials, that prove Gilmore’s innocence in the fire. The documentary points to buried evidence that incriminates two other men, Gerardo Giovanni ‘Clutter’ Salazar, allegedly, white, born 1987, and Gerald Wayne Carter, allegedly, not of Hispanic origin, born 1968, who were the first suspects questioned.
For unknown reasons, these men were dismissed by the Fort Collins Police Department. Allegedly, investigators put Salazar on a bus to Oregon where he died mysteriously before the trial. Read more.
According to this article by We are Change Colorado activist, Bruce Baumann, witnesses testified under oath that suspect Gerardo ‘Clutter’ Salazar admitted to setting the fire. Incredibly, in an unfathomable move of incompetence, investigators sent Salazar’s clothes for evaluation by experts in California, and then told them NOT to investigate! Investigators told the experts to return the clothes untested!

About the Gilmore situation, Bruce says, “It gets worse… As the fire raged, the first witness on the scene was Gerald Carter, who was told to… leave the scene. Investigators cleared him as a suspect without any interviews and went as far as deleting him from their criminal database!”
The police report shows that Salazar admitted he joked to witnesses about throwing Molotov cocktails at the building! Nevertheless, the Fort Collins police let him go without any other interviews or surveillance.
“Lt. James Broderick, the lead investigator on the Tim Masters’ case was indicted by a grand jury on federal perjury charges for his involvement in the case. After surviving the lengthy and expensive court battle, he resigned with his pension, but admitted mistakes investigating Masters, including ‘tunnel vision’ on the part of investigators who focused only on Masters as a suspect in their zeal to get a conviction.
“The similarities between the two cases include Fort Collins’ investigators reliance on a few pieces of evidence and the exclusion of many significant items of direct evidence. For example, Gilmore’s Rolex watch was found at the scene and burns on his hands dictated their whole investigation. Gilmore, who doesn’t have his left hand, burned his hands while he was practicing the art of fire poi spinning.
“Why would Gilmore leave an expensive Rolex watch, with his name on it, at the scene of an arson fire? Prosecutors claimed it was either caught on a nail or it became too hot and he had to remove it.
“They failed to address that Gerardo ‘Clutter’ Salazar worked for Gilmore at the family’s successful local business, Copoco’s Honey and that he also had access to Gilmore’s house. Prosecutors also failed to address the fact that homeless people were staying on the third floor of the apartment building that was under construction; those homeless men were reportedly using Sterno cans as a heat source.
“Why would Police want to prosecute Benjamin Gilmore? Gilmore was looked up to by the community for his beekeeping skills. He was also a vocal and inspiring member of the beginning stages of Fort Collins’ Occupy Wall Street movement.
“He was a non-violent unappointed leader of Occupy who threatened the establishment by being a well-liked and outspoken critic of the United States’ endless wars of occupation and of the privately owned Federal Reserve funding them. The fires at the Mason Flats/Penny Flats Apartments were one block away from the Occupy Fort Collins encampment and the media immediately hyped Gilmore as a suspect.” Read more. Filmmaker Law Johnston also created this film, The Stacy Lynn Story, to document the turbulent last few years of Stacy Lynne’s life. Stacy’s success exposing Agenda 21 and I.C.L.E.I. led to the retaliatory taking and loss of custody of her son, Jaden.
